Terms of Service

1. What This Agreement Covers

These Terms of Service ("Terms") are a legal agreement between you and GOBYTE SOFTWARE LTD, a company registered in England & Wales under company number 16769913, with registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("we", "us", "our"). They apply to your use of Punapai, our landing page builder ("Service").

By creating an account, you agree to these Terms. If you do not agree, please do not use the Service.

2. What Punapai Does

Punapai lets you build, customise, and publish landing pages. We may add, change, or remove features at any time to improve the Service.

3. Your Account

When you sign up, you must provide truthful information. You are responsible for keeping your login details secure. Everything that happens under your account is your responsibility.

4. What You Must Not Do

You must not use Punapai to:

  • Break any law or regulation
  • Use someone else's copyrighted material without permission
  • Spread malware, spam, or harmful content
  • Build landing pages that scam, mislead, or defraud people
  • Collect personal data from visitors for unlawful purposes
  • Try to hack or disrupt our systems
  • Promote products or services using false or misleading claims

We may remove content or suspend accounts that violate these rules without prior notice.

5. Affiliate Marketing & Advertising Compliance

Punapai is designed for building landing pages, including pages that promote products or services through affiliate links. If you use the Service for affiliate marketing or any form of advertising, you are solely responsible for:

  • Complying with all applicable advertising laws and regulations, including the UK Advertising Standards Authority (ASA) CAP Code, the US Federal Trade Commission (FTC) Endorsement Guides, and any other local advertising standards that apply to your audience
  • Clearly and prominently disclosing that your landing page contains affiliate links or sponsored content, as required by law
  • Ensuring that all claims made on your landing pages about products or services are truthful, accurate, and not misleading
  • Complying with the terms and conditions of any affiliate programme you participate in

We do not review your landing pages for advertising compliance. Failure to comply with applicable advertising regulations may result in removal of your content and suspension of your account.

6. Data Protection on Your Landing Pages

You become a data controller under the UK GDPR (and equivalent EU rules) the moment your landing page collects or transmits personal data about visitors. This includes:

  • Adding an Email collect block on your page
  • Adding a Contact form block on your page
  • Configuring your own Google Analytics measurement ID (G-…) on the project
  • Configuring your own Google Tag Manager container ID (GTM-…) on the project

If your landing page does any of the above, you must:

  • Provide a privacy notice of your own that explains who you are, what visitor data you collect, why, your lawful basis (typically consent or legitimate interests), how long you keep it, and how visitors can exercise their rights
  • Add the URL of that privacy notice to your project using the Privacy Policy URL field on the project settings page. Once set, it replaces the default link in the cookie-consent banner shown on your published page
  • Have a lawful basis for collecting any personal data — most commonly the visitor's freely-given consent, captured by the consent banner that we provide
  • Respond to any data subject requests (access, deletion, rectification, etc.) you receive about visitor data
  • Comply with the equivalent rules in any other jurisdiction your visitors are in (Germany's Telemediengesetz, France's LCEN, etc.)

We act as a data processor on your behalf for that visitor data — we store it, route form submissions, and provide the cookie-consent banner. The relationship and our obligations as a processor are described in our Privacy Policy. A formal Data Processing Agreement (DPA) is available on request.

You are solely responsible for the accuracy and completeness of your privacy notice and for compliance with applicable data-protection laws. Failure to provide a privacy notice when required, or providing one that is materially misleading, is your responsibility — not ours — and we accept no liability for fines, complaints, or claims arising from it.

To help you comply, our editor includes a Business Info block (for Companies Act / Impressum / similar trader-identification rules) and the Privacy Policy URL project field referenced above. Whether you use them is up to you.

7. Third-Party Links & Content

Your landing pages may contain links to third-party websites, products, or services (including affiliate links). We have no control over and accept no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge that we are not liable for any loss or damage arising from your use of, or reliance on, any third-party content linked from your landing pages.

Visitors who click on links in your landing pages do so at their own risk. It is your responsibility to ensure that the products and services you promote are legitimate.

8. Content Moderation & Page Removal

We reserve the right to review, disable, or permanently remove any landing page at our sole discretion, including but not limited to pages that:

  • Are reported as fraudulent, deceptive, or misleading
  • Are flagged as scams by users, third parties, or automated systems
  • Violate any applicable law or regulation
  • Contain harmful, abusive, or objectionable content
  • Infringe on the rights of others

We are under no obligation to notify you before taking action. If your page is removed, you may contact us to request a review, but we are not required to reinstate it.

9. Plans & Billing

Punapai offers a free plan and paid subscription plans (Pro, Business, Enterprise). Each plan has its own feature limits, including the number of projects, email subscribers, contact form submissions, deployment servers, analytics retention, and page lifetime.

9.1 Free Plan

  • Project limit: free accounts may create up to 2 projects
  • Expiration: projects on free accounts expire 30 days after publishing. Once expired, the landing page will no longer be publicly accessible
  • Data removal: after expiration, all project assets (pages, images, files) and any data collected through the landing page will be permanently deleted

9.2 Paid Subscriptions

Paid plans are billed monthly or yearly through our payment processor, Stripe. By subscribing, you authorise recurring charges to your chosen payment method.

  • Upgrades: when you upgrade to a higher plan, you will be charged the prorated difference immediately
  • Downgrades: when you downgrade to a lower paid plan, the change takes effect at the end of your current billing period
  • Cancellation: you may cancel your subscription at any time. Your plan features remain available until the end of the current billing period, after which your account reverts to the free plan
  • Refunds: outside the statutory cooling-off period below, payments are non-refundable except where required by law. If you have concerns about a charge, contact us

9.3 UK Consumer Cooling-Off Right

If you are a consumer in the United Kingdom, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you a 14-day right to cancel a new paid subscription without giving any reason, beginning on the day the subscription starts. To exercise this right, email us at stefanos@gobyte.software within 14 days of subscribing.

Express request and waiver: Punapai is a digital service made available to you immediately on subscription. By starting to use the Service before the 14-day cancellation period has expired, you expressly request that we begin performance during the cancellation period and you acknowledge that you will lose your right to cancel once the Service has been fully supplied. If you cancel after starting to use the Service, we may charge you a proportionate amount for the use you have made of the Service up to the point you cancelled.

This cooling-off right does not apply to renewals of an existing subscription, only to a new subscription you have just started.

9.4 Plan Changes

We may change plan pricing or features with reasonable notice. Existing subscribers will be given at least 30 days' notice before any price increase takes effect on their next billing cycle.

10. Who Owns What

Your content is yours. The landing pages and content you create belong to you. We only use your content to run the Service (for example, hosting and displaying your pages).

Our platform is ours. The Punapai software, design, branding, and code are the property of GOBYTE SOFTWARE LTD. You may not copy, modify, or redistribute any part of it.

11. Copyright & Takedown Requests

We respect intellectual property rights. If you believe that content hosted on Punapai infringes your copyright or other intellectual property rights, please contact us at stefanos@gobyte.software with the following information:

  • A description of the copyrighted work you believe has been infringed
  • The URL of the landing page containing the alleged infringing content
  • Your contact information (name, email address, and phone number)
  • A statement that you have a good-faith belief that the use is not authorised by the copyright owner
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf

We will review valid takedown requests and take appropriate action, which may include removing the content and notifying the account holder.

12. Indemnification

You agree to indemnify, defend, and hold harmless GOBYTE SOFTWARE LTD, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use of the Service
  • Content you create, publish, or distribute through the Service
  • Your violation of these Terms or any applicable law or regulation
  • Your violation of any third party's rights, including intellectual property, privacy, or advertising rights
  • Any claims made by visitors to your landing pages or by the owners of products or services you promote

13. Limits on Our Responsibility

We do our best to keep Punapai running smoothly, but we cannot guarantee it will always be available or error-free. The Service is provided "as is".

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages (such as lost profits, lost revenue, lost goodwill, or lost or corrupted data) arising from or in connection with your use of the Service.

Our total aggregate liability to you for any claim arising out of or in connection with these Terms or the Service, whether in contract, tort (including negligence), or otherwise, is limited to the greater of (a) the amount you paid us for the Service in the twelve months immediately preceding the event giving rise to the claim, or (b) one hundred pounds sterling (£100).

Nothing in these Terms limits or excludes:

  • our liability for death or personal injury caused by our negligence;
  • our liability for fraud or fraudulent misrepresentation;
  • your statutory rights as a consumer that cannot be limited or excluded under English law (including under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013); or
  • any other liability that cannot lawfully be limited or excluded.

14. Closing Your Account

By you: You can delete your account at any time from your account settings. If you have an active subscription, it will be cancelled and you will not be charged again.

By us: We may suspend or close your account if you break these Terms. If we do, your access ends immediately and any active subscription will be cancelled.

15. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will let you know by email or through the Service. By continuing to use Punapai after a change, you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any legal disputes will be handled by the courts of England and Wales.
